Terms of Service

1. Agreement to terms
By accessing or using Kidera ("the Service," "the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Kidera.
These Terms constitute a legally binding agreement between you and Kidera. Please read them carefully.
2. Description of service
Kidera is a private family journaling application that allows parents and guardians to:
- Create and maintain private digital journals about their children
- Upload, store, and organize photos and videos
- Use AI-powered features to describe photos, extract milestones, and search memories
- Share their family journal with one invited partner
- Receive weekly email summaries of their journal activity
3. Eligibility
3.1 Age requirement
You must be at least 18 years old to create a Kidera account. By creating an account, you represent and warrant that you are at least 18 years old.
3.2 Parental or guardian status
Kidera is designed for use by parents and legal guardians. By adding a child profile to your journal, you represent that you are the parent or legal guardian of that child and have the authority to share information about that child with Kidera and its service providers.
3.3 Account accuracy
You agree to provide accurate, current, and complete information when creating your account and to update this information as needed to keep it accurate.
4. Accounts
4.1 Account creation
You may create an account using Google OAuth or email and password authentication, managed by Clerk. You are responsible for maintaining the security of your account credentials.
4.2 One account per family
Kidera is designed for family use. You may invite one partner to share your family journal. Each family should maintain one shared journal rather than multiple separate accounts for the same family.
4.3 Account security
You are responsible for all activity that occurs under your account. Notify us immediately at help@kidera.co if you suspect unauthorized access to your account. We are not liable for losses caused by unauthorized use of your account.
4.4 Account termination by you
You may delete your account at any time through the Delete Account feature in Profile settings. Account deletion is permanent and irreversible. All data associated with your account will be permanently deleted.
5. Acceptable use
5.1 Permitted use
You may use Kidera only for lawful personal family journaling purposes as intended by the Service.
5.2 Prohibited uses
You agree not to use Kidera to:
- Upload, store, or share any illegal content
- Upload content that depicts child abuse, exploitation, or any harm to minors
- Upload sexually explicit content of any kind
- Impersonate any person or entity
- Harass, threaten, or harm any person
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use automated scripts, bots, or scrapers to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service in any way that could damage, disable, or impair our infrastructure
- Circumvent any security measures or access controls
- Share your account credentials with anyone other than an invited partner through our official invite system
- Use the Service for any commercial purpose other than as a paying subscriber for personal use
- Upload content that infringes any third party's intellectual property rights
- Upload content that violates any applicable law or regulation
5.3 Content standards
All content you upload or create in Kidera must:
- Be content you have the right to upload and store
- Not violate any person's privacy or publicity rights
- Not constitute defamation, harassment, or illegal discrimination
- Not contain malware, viruses, or malicious code
5.4 Enforcement
We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that repeatedly or egregiously violate these Terms, without notice and without liability.
6. Content ownership and licenses
6.1 Your content
You retain full ownership of all content you create and upload to Kidera, including journal entries, photos, videos, and any other content ("Your Content"). These Terms do not transfer any ownership of Your Content to us.
6.2 License to us
By uploading or creating content in Kidera, you grant us a limited, non-exclusive, royalty-free license to:
- Store, process, and display Your Content to provide the Service to you
- Process Your Content through our AI service providers (OpenAI, Cohere) as described in our Privacy Policy
- Create thumbnails, previews, and compressed versions of your media files
- Back up Your Content to ensure service reliability
This license exists solely to enable us to provide the Service to you. We do not claim any other rights to Your Content.
6.3 No training on your content
We do not use Your Content to train any AI models. Your journal entries, photos, and personal data are never used for AI training purposes by us or our service providers under our agreements with them.
6.4 Content representations
By uploading content to Kidera, you represent and warrant that:
- You own the content or have the right to upload it
- The content does not violate any third party's rights
- The content complies with these Terms and all applicable laws
- You have the necessary consents for any identifiable persons depicted in photos or videos, particularly for sharing with an invited partner
6.5 Our intellectual property
All aspects of the Kidera Service not comprising Your Content — including the software, design, features, AI pipelines, trademarks, and trade dress — are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without our express written permission.
7. Subscription and payments
7.1 Free plan
Kidera offers a free plan with limited features including up to 5GB of storage and 10 AI questions. The free plan is available indefinitely subject to these Terms.
7.2 Pro plan
Kidera Pro is available on a monthly ($9/month) or yearly ($72/year) subscription basis. Pro subscribers receive unlimited storage, unlimited AI questions, AI photo descriptions, partner invite access, and weekly email summaries.
7.3 Payment processing
All payments are processed by Lemon Squeezy. By subscribing to Kidera Pro, you agree to Lemon Squeezy's terms of service and authorize them to charge your payment method on a recurring basis.
7.4 Billing
- Monthly subscriptions are billed every 30 days from your subscription start date
- Yearly subscriptions are billed annually from your subscription start date
- Prices are in US dollars and are exclusive of any applicable taxes
- We reserve the right to change subscription prices with 30 days notice
7.5 Cancellation
You may cancel your subscription at any time through the Manage Subscription link in your Profile settings, which takes you to Lemon Squeezy's customer portal. Upon cancellation:
- Your Pro access continues until the end of your current billing period
- You will not receive a refund for the unused portion of your current billing period
- Your account will revert to the free plan at the end of the billing period
- Your data will be retained but subject to free plan storage limits
7.6 Refunds
- Monthly subscriptions: refund requests within 7 days of initial subscription or renewal will be considered on a case-by-case basis
- Yearly subscriptions: refund requests within 14 days of initial subscription will be considered on a case-by-case basis
- No refunds will be issued after these periods

7.7 Price changes
We reserve the right to change our subscription prices. We will provide at least 30 days notice of any price changes via email. Continued use of the Service after a price change constitutes acceptance of the new price.
7.8 Partner plan access
When you invite a partner to your family journal, your partner receives Pro access tied to your subscription. If your subscription is cancelled or lapses, your partner's Pro access is also revoked. The invited partner does not have an independent subscription obligation while using your shared journal.
8. Storage limits
8.1 Free plan storage
Free plan users are limited to 5GB of combined photo and video storage. When you reach this limit, you will not be able to upload additional media until you upgrade to Pro or delete existing media.
8.2 Pro plan storage
Pro plan subscribers have unlimited storage for photos and videos.
8.3 Fair use
While Pro plan storage is described as unlimited, we reserve the right to contact subscribers whose usage significantly exceeds normal family journaling use cases and work with them on appropriate solutions.
9. AI features
9.1 Nature of AI features
Kidera's AI features — including photo descriptions, metadata extraction, milestone detection, and the Ask Your Journal feature — are provided as convenience tools and may not always be accurate. AI-generated content is automatically generated and may contain errors, omissions, or inaccuracies.
9.2 No reliance on AI content
You should not rely on AI-generated content in Kidera for medical, legal, developmental, or any other professional advice. AI-generated milestone categories and developmental descriptions are for organizational and memory purposes only, not professional assessments.
9.3 AI feature availability
We may modify, limit, or discontinue AI features at any time. Changes to AI features do not constitute a material change to the Service warranting a refund.
10. Data export and portability
You have the right to export all your data at any time using the Export All Data feature in Profile settings. We will provide your data in a standard ZIP format including all journal entries, photos, and videos. We encourage you to regularly export your data as a personal backup.
11. Service availability and modifications
11.1 Service availability
We strive to maintain high availability of Kidera but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control.
11.2 Modifications to the service
We reserve the right to modify, update, or discontinue any aspect of the Service at any time. We will provide reasonable notice of material changes that negatively impact your use of the Service.
11.3 Service discontinuation
In the unlikely event that we discontinue Kidera entirely, we will provide at least 90 days notice and ensure you have adequate time and tools to export all your data before the Service is shut down.
12. Disclaimers and limitation of liability
12.1 Service provided "as is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
12.2 No guarantee of data preservation
While we take extensive measures to protect and preserve your data, we cannot guarantee against data loss. We strongly recommend using the Export feature regularly to maintain your own backups of your precious family memories.
12.3 Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIDERA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
12.4 Essential basis
THE LIMITATIONS OF LIABILITY IN THIS SECTION ARE A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND KIDERA. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify, defend, and hold harmless Kidera and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service
- Your Content
- Your violation of these Terms
- Your violation of any applicable law or third party rights
14. Privacy
Your use of Kidera is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Kidera, you agree to our Privacy Policy.
15. Dispute resolution
15.1 Informal resolution
Before initiating any formal dispute, you agree to contact us at help@kidera.co and attempt to resolve the dispute informally. We will make reasonable efforts to resolve disputes informally within 30 days.
15.2 Governing law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.
15.3 Jurisdiction
Any legal proceedings arising out of or related to these Terms shall be brought exclusively in the state and federal courts located in the State of California, and you consent to personal jurisdiction in those courts.
15.4 Class action waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS OR CLASS-WIDE ARBITRATION AGAINST KIDERA.
16. General provisions
16.1 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kidera regarding the Service and supersede all prior agreements.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
16.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
16.5 Force majeure
We shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, acts of government, power failures, or internet outages.
16.6 Changes to terms
We may update these Terms from time to time. We will notify you of material changes via email and by updating the "Last Updated" date. Continued use of the Service after changes are effective constitutes acceptance of the updated Terms.
